HOTSHOT PRIVACY NOTICE

This Privacy Notice is designed to help you understand how Hotshot and PH7, Ltd. (“we,” “us,” or “our”) collect, use, disclose, and otherwise handle your personal information in connection with Hotshot events, event registrations, ticketing, admissions, communications, and related promotions or programs, and to help you understand and exercise your privacy rights. Please read this Privacy Notice carefully.

1. SCOPE

This Privacy Notice applies to personal information we process in connection with Hotshot events and related online or offline offerings, including event listings, RSVP registration, ticketing, admissions, event communications, promotions, and other related activities (collectively, the “Services”).

2. CHANGES TO THIS PRIVACY NOTICE

We may revise this Privacy Notice from time to time at our sole discretion. If there are any material changes to this Privacy Notice, we will notify you and obtain your consent where required by applicable law. We will review and update this Privacy Notice at least once every twelve (12) months, or sooner if our data practices materially change, and include the date of the last update.

You understand and agree that you will be deemed to have accepted the updated Privacy Notice if you continue to participate in our Services after the new Privacy Notice takes effect.

3. NOTICE AT COLLECTION

We are required by California law (CCPA/CPRA) to inform consumers, at or before the point of collection, about the categories of Personal Information we collect and the purposes for that collection. This section provides a summary. For full detail on our collection methods, sources, retention, and disclosures, please refer to the sections below.

The table below summarizes the categories of Personal Information we collect from you, the purposes for which we use the information, the criteria we use for retention, and whether we “Sell” or “Share” the information for cross-context behavioral advertising.

4. BIOMETRIC INFORMATION POLICY

We do not intentionally collect biometric information in connection with ordinary Hotshot event registration, ticketing, admissions, or event attendance.

If we ever collect biometric information in connection with a specific Hotshot event or feature, we will provide additional notice at or before the point of collection, obtain any consent required by applicable law, describe the purpose of the collection, and retain and delete such information in accordance with applicable law.

5. PERSONAL INFORMATION WE COLLECT

The categories of personal information we collect depend on how you interact with us, our Services, and the requirements of applicable law. We collect information that you provide to us and information from other sources, such as third-party platforms, payment processors, service providers, and organizations, as described below.

Information You Provide to Us Directly

We may collect the following personal information that you provide to us.

Event Registration and Attendance Information. We may collect personal information in connection with event listings, RSVP registration, admissions management, ticketing, event attendance, event-related communications, promotions, or community programs, including your name, email address, phone number where collected, RSVP status, admissions information, social handle, and, where applicable, purchase and payment-related information.

Ticketing and Payment Information. We may collect personal information such as your name, email address, ticket or purchase ID, purchase date and time, transaction information, and payment-related information in connection with ticket sales, admissions, transaction administration, fraud prevention, and customer support.

Your Communications with Us. We may collect personal information, such as your name, email address, phone number where collected, social handle, the content of your communications, support history, and attached information when you request information about our Services, contact us regarding an event, request customer support, or otherwise communicate with us.

Surveys and Promotions. We may contact you to participate in surveys, promotions, opportunities, or community programs. If you decide to participate, you may be asked to provide certain information, which may include personal information.

Event Photography and Videography. We may collect photos, videos, audio, and related audio/visual information in connection with events for event documentation, publicity, social media posting, promotional communications, event recaps, and related business purposes, as further disclosed at the point of collection or at the event venue.

Information Collected Automatically

We may collect limited technical information automatically when you interact directly with our own websites, pages, or communications, where applicable.

If you access RSVP registration, ticketing, or related event features through third-party platforms, those third parties may independently collect technical and usage information in accordance with their own privacy notices and policies. We do not control those third-party collection practices where we do not receive or access that information ourselves.

Information Collected from Other Sources

We may obtain information about you from other sources, including through third-party services and organizations. For example, we may collect information from third-party event listing platforms, RSVP platforms, ticketing platforms, payment processors, venue operators, service providers, social networking services, or partners involved in administering events, promotions, or community programs.

For clarity, where third-party event or RSVP platforms collect technical or usage data solely for their own platform operations and do not provide that information to us, such information is governed by the privacy practices of those third parties rather than this Privacy Notice.

6. HOW WE USE YOUR INFORMATION

We use your information for a variety of business purposes, including providing our Services, providing administrative services, and promoting our events and related activities, as described below.

Provide Our Services

We use your information to provide you with our Services, such as:

  • managing RSVP registration, admissions, and attendance;

  • processing ticket sales, payments, and related transactions;

  • communicating with you about an event, your registration, your attendance, policy updates, and related matters;

  • providing customer or technical support;

  • administering promotions, opportunities, surveys, or community programs;

  • managing event operations, safety and security, and attendee support;

  • maintaining transaction, admissions, and operational records;

  • preventing fraud and misuse; and

  • analyzing and improving our Services through internal research and data analytics.

Administrative Purposes

We use your information for various administrative purposes, such as:

  • detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;

  • measuring interest and engagement in our Services;

  • improving, upgrading, or enhancing our Services;

  • developing new products, events, promotions, or related offerings;

  • ensuring internal quality control and safety;

  • authenticating and verifying individual identities where appropriate;

  • debugging to identify and repair errors with our Services;

  • auditing relating to interactions, transactions, and other compliance activities;

  • enforcing our agreements and policies; and

  • complying with our legal obligations.

Other Purposes

We also use your information for other purposes as requested by you or as permitted by applicable law.

Consent. We may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information or with your consent.

De-identified and Aggregated Information. We may use personal information and other information about you to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified event participation information, or other analyses we create.

7. HOW WE DISCLOSE YOUR INFORMATION

We disclose your information to third parties for a variety of business purposes, including to provide our Services, to protect us or others, or in the event of a major business transaction, as described below.

Disclosures to Provide Our Services

The categories of third parties with whom we may disclose your information are described below.

Service Providers and Contractors. We may disclose your personal information to third-party service providers and contractors who use that information to help us provide our Services. This includes service providers and contractors that support event listings, RSVP management, admissions, ticketing, payment processing, hosting, venue operations, customer support, communications, cloud storage, security, and related operational services.

Affiliates. We may disclose your personal information with our company affiliates for business purposes consistent with this Privacy Notice, such as to provide our Services, ensure security and fraud prevention, or for internal reporting and management. Our affiliates will process your information in accordance with our instructions and are subject to appropriate confidentiality and security measures.

Analytics Providers. We may disclose de-identified or aggregated data to analytics providers to perform analytics and improve our Services. These providers are contractually restricted from using this information for any purpose other than providing these services to us.

APIs / SDKs / Platform Providers. We may use third-party application program interfaces (“APIs”), software development kits (“SDKs”), platform providers, RSVP providers, ticketing providers, and payment providers as part of our Services and to perform the business purposes described in this Privacy Notice.

Disclosures to Protect Us or Others

We may access, preserve, and disclose information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to comply with legal process or law enforcement requests, protect your, our, or others’ rights, property, or safety, enforce our policies or contracts, collect amounts owed to us, or assist with an investigation or prosecution of suspected or actual illegal activity.

Disclosure in the Event of Merger, Sale, or Other Asset Transfers

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

We do not sell or share personal information for cross-context behavioral advertising.

8. YOUR PRIVACY CHOICES AND RIGHTS

Your privacy choices and rights are determined by applicable law and are described below.

Your Privacy Choices

Cookies and Data Collection. You can control or restrict the use of cookies and similar technologies by adjusting your browser or device settings. Please note that if you disable these technologies, some parts of our Services may not function properly. We do not “sell” your personal information or “share” your personal information for cross-context behavioral advertising as defined under applicable law. Accordingly, while we recognize the importance of privacy preference signals such as Global Privacy Control (GPC), we do not currently engage in activities that would require us to process such signals for opt-out purposes.

Your Privacy Rights

In accordance with applicable law, you may have the right to:

  • access personal information about you, including confirming whether we are processing your personal information, obtaining access to or a copy of your personal information, and receiving an electronic copy of personal information that you have provided to us;

  • request correction of your personal information where it is inaccurate or incomplete; and

  • request deletion of your personal information, subject to applicable exceptions.

If you would like to exercise any of these rights, please contact us as set forth in Section 15 below. We will process such requests in accordance with applicable law.

9. SECURITY OF YOUR INFORMATION

We take steps to ensure that your information is treated securely and in accordance with this Privacy Notice. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We have taken appropriate safeguards and require our relevant third-party service providers and partners to maintain appropriate safeguards as well. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. If we learn of a security system breach, we may attempt to notify you electronically by posting a notice on our Services, or by sending an email to you.

10. SECURITY OF COMMUNICATIONS

We use industry-standard security measures, including appropriate encryption for data in transit and at rest where applicable, to protect personal information processed in connection with our Services.

11. RETENTION OF PERSONAL INFORMATION

We store the personal information we collect as described in this Privacy Notice for as long as necessary to fulfill the purpose(s) for which it was collected, including to administer RSVP registration, admissions, ticketing, payment processing, event operations, participant support, safety and security, publicity or event recap purposes where disclosed, resolve disputes, establish legal defenses, conduct audits, enforce our agreements, and comply with applicable laws.

12. SUPPLEMENTAL NOTICE FOR U.S. RESIDENTS

This U.S. Privacy Notice covers our information collection practices and describes your rights regarding your personal information for residents of the United States. All terms defined in applicable U.S. state privacy laws have the same meanings when used in this section.

Categories of personal information we collect

U.S. residents have the right to know what categories of personal information we collected about them and whether we disclosed that personal information for a business purpose in the preceding 12 months. U.S. residents can find this information below.

“Sales” or “Share” of Personal Information under State Privacy Laws

For the purposes of applicable state privacy laws, Hotshot and PH7, Ltd. do not “Sell” personal information and do not “Share” personal information for cross-context behavioral advertising.

Additional Privacy Rights for U.S. Residents

You may exercise your rights by submitting a verifiable consumer request through the methods identified in Section 15 below.

Non-Discrimination. U.S. residents have the right not to receive discriminatory treatment for the exercise of their privacy rights.

Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

Verification. To protect your privacy, we will take reasonable steps to verify your identity before fulfilling your request.

Nevada Residents. Nevada residents have the right to submit a verified request directing us not to sell personal information. We do not sell personal information as defined by Nevada law.

California Shine the Light. We do not disclose personal information to third parties for their own direct marketing purposes in a manner that would trigger an obligation to provide a Shine the Light disclosure, unless otherwise required by law.

13. CHILDREN’S INFORMATION

Our Services are not directed to children under 13 in the United States or under the applicable age of consent in other jurisdictions. We do not knowingly collect personal information from children in violation of applicable law. If we learn that we have inadvertently collected personal information from a child in violation of applicable law, we will take reasonable steps to delete that information.

14. THIRD-PARTY WEBSITES / APPLICATIONS

Our Services may contain links to third-party websites, applications, or platforms. These third-party services are not controlled by us. We encourage you to review the privacy policies of any third-party services with which you interact. We are not responsible for the privacy practices or content of such third-party services.

This includes third-party event listing, RSVP, ticketing, and payment platforms. These third parties may collect information directly from you or automatically through their own platforms for their own operational purposes, and such collection is governed by their own privacy notices and policies.
