EVENT TERMS AND CONDITIONS

LEGAL WARNING: THIS IS A CONTRACT. BY PURCHASING A TICKET, REGISTERING FOR AN RSVP, OR ENTERING THE EVENT VENUE, YOU ARE ENTERING INTO A LEGALLY BINDING AGREEMENT AND WAIVING SIGNIFICANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE PH7, LTD. AND ITS PARTNERS. IF YOU DO NOT AGREE TO EVERY TERM BELOW, DO NOT PURCHASE A TICKET, REGISTER, OR PREPARE TO ENTER THE PREMISES.
1. Definition of Parties
This Agreement is executed between the individual ticket purchaser, registrant, or attendee ("Participant", "you", or "your") and PH7, Ltd., along with its parent companies, subsidiaries, affiliates, student groups, and brands, including but not limited to "Hotshot" ("Company", "we", "us", or "our").
2. Absolute Age Cap, Mandatory Identification, and Fraud Protection

Strict Age Enforcement: This Event is strictly restricted to individuals aged 18 and older. No person under the age of 18 shall be admitted under any circumstances, regardless of parental or guardian consent.

Verification Protocols: To gain entry, you must present a valid, original, unexpired government-issued photo identification (e.g., Driver’s License, State ID, or Passport). The Company reserves the absolute right to confiscate any identification document suspected of being fraudulent, altered, or belonging to another individual, and to turn such documents over to law enforcement. Photo copies, digital reproductions, and student or university identification cards are strictly invalid for entry.

Strict No-Alcohol Policy: The sale, distribution, possession, or consumption of alcohol by any participant, guest, or performer is ABSOLUTELY PROHIBITED on the premises. No alcohol will be served or allowed under any circumstances. Any individual violating this rule will be immediately ejected from the venue and banned from future events.
3. Absolute Discretion Over Admission, Ejection, and Orderly Conduct

Right of Refusal: The Company, the venue providers, and their designated security personnel reserve the right, at their sole and unfettered discretion, to refuse admission to, or eject from the venue, any Participant at any time, for any reason or no reason at all.

Prohibited Items and Behaviors: Grounds for immediate denial of entry or forcible ejection include, but are not limited to: visible intoxication or impairment; disorderly, aggressive, disrespectful, unsafe, or non-compliant conduct; possession of illegal substances, weapons, or outside alcohol; failure to comply with safety and security screening protocols (including bag checks); or violation of any venue policies, student council rules, or house rules.
4. Irrevocable Commercial Crowd Release and Media Consent

Media Capture Notice: Participant acknowledges and agrees that commercial photography, audio recording, and video recording will take place throughout the Event venue.

Perpetual Worldwide Grant of Rights: By entering the Event premises, Participant hereby grants PH7, Ltd., its subsidiaries, affiliates, and partners, a perpetual, irrevocable, royalty-free, sub-licensable, worldwide right and license to capture, record, broadcast, publish, edit, transmit, and utilize Participant’s likeness, voice, image, movements, and actions in any and all media now known or hereafter devised (including but not limited to Instagram, TikTok, YouTube, websites, recap videos, and future promotional applications) for marketing, public relations, commercial exploitation, and advertising purposes without further notice, review, approval, or financial compensation. You completely waive any right to privacy, publicity, or moral rights associated with such media.
5. Express Assumption of Risk

Participant explicitly acknowledges that attendance at a live, crowded music event involves inherent risks, both known and unknown. These risks include, but are not limited to: physical injury, illness, hearing damage from loud music, exposure to flashing lights, slips, trips, falls, and the behavior of other event attendees. Participant voluntarily, knowingly, and fully assumes all risks, hazards, and dangers incidental to the Event, whether occurring prior to, during, or subsequent to the actual performance.
6. Total Liability Waiver and Covenant Not to Sue

Complete Indemnity: To the maximum extent permitted by applicable law, Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, and forever discharges and holds harmless PH7, Ltd., its directors, officers, employees, agents, contractors, venue owners (Theta Delta Chi), and performing artists from any and all liabilities, claims, demands, costs, expenses, damages, or causes of action arising out of or related to any personal injury, illness, death, or property damage/loss sustained at or in connection with the Event, whether caused by the active or passive negligence of the Company or otherwise.

Covenant Not to Sue: Participant promises and covenants never to initiate, support, or maintain any lawsuit, claim, or legal proceeding against PH7, Ltd. or its affiliated partners for any matter waived under this agreement.

Personal Property Liability: The Company and the venue providers take absolutely zero responsibility or liability for lost, stolen, or damaged personal belongings (such as phones, wallets, jewelry, or apparel) brought into the venue. All personal property remains the sole responsibility of the Participant at all times.
7. California Civil Code Section 1542 Waiver

Participant explicitly waives all rights under California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." Participant understands that they are releasing claims that may currently be unknown to them.
8. Severability, Governing Law, and Exclusive Jurisdiction

Severability: If any provision or sub-clause of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Governing Law: This Agreement shall be governed by, interpreted, and enforced exclusively in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal action arising from these terms or the Event must be filed exclusively in the state or federal courts located in Los Angeles County, California.
9. Terms for Guest Performers (DJs)

Assumption of Risk: All non-paid, guest, or student performers ("Performers") enter and perform at their own risk. PH7, Ltd. and the venue (Theta Delta Chi) accept zero liability for any personal injuries, illnesses, or accidents sustained during the event, regardless of the cause.

Equipment & Property: Performers are solely responsible for any damage they cause by negligence or misuse to the venue or PH7’s sound systems and equipment. Furthermore, PH7 and the venue are not responsible for any lost, stolen, or damaged personal gear (laptops, headphones, etc.) brought by the Performers.
